Rental agreement

1.- DRIVER age not less than 25 years. Valid driving license (B1), 2 years old and the company will be given a copy on both sides of the driver’s license and ID, both in force at the time of making the vehicle reservation.

2.- The reservation of a vehicle will be made with the payment of 30% of the total rent as a reservation signal. In the event that the client cancels the requested reservation, the following penalties will be applied to the signal:

• If communicated before 30 days from the start of the rental: 50% of the reservation.
• If you communicate between 30 and 16 days before the start of the rental: 80% of the reservation.
• If you communicate with less than 16 days until the start of the rental: 100% of the reservation.

3.- The total amount of the contracted rental must be paid one week (7 days) before departure, by bank transfer or Bizzum. Likewise, the deposit will be added to the total rental to guarantee the proper use and correct return of the vehicle, for an amount of €700.

4.- The client will not proceed to demand any compensation, if due to force majeure or fortuitous cause, the vehicle could not be delivered on the agreed day

5.- In the event that the tenant, by his own unilateral decision, starts the rental late or ends the rental early, he will not have the right to claim for any refund.

6.- The delivery of the vehicle will be made from 12:00 AM, in the place indicated by the lessor, the same as the return, which will be before 7:00 PM on the day the lease ends. The lessee undertakes, both at the reception and at the return of the vehicle, to allow sufficient time to receive instructions on its operation, in addition to participating in the checking and signing of the vehicle inspection, which takes approximately 1 hour.

The time fixed for the return of the vehicle can be specified in the reservation document that accompanies this contract. In this case, the schedule specified in the observations of the reservation document must be obeyed.

7.- It is expressly prohibited to use the vehicle for any activity contrary to morality, laws and good customs. It is expressly prohibited to transport more people than permitted by law, carry out races, transport goods or objects, whether or not they are permitted by our legislation, assign their use for free or for profit, as well as cover or remove the anagrams of the business.

8.- The lessee is responsible for any sanction or fine, who, for contravening the current provisions were imposed, reached the same responsibility in the event that the vehicle was retained or seized because of his fault, also running, with the expenses and lost profits of this leasing company during the time it lasts the unavailability of the vehicle, applying for each day that the amount per day was withheld or seized, depending on the model and current rates of the rental price.

9.- In the event of a stoppage of the vehicle for reasons solely and exclusively attributable to the client, the latter will be responsible for each and every one of the damages derived from said stoppage.

10.-The leased vehicle must be returned clean and in good hygienic conditions, both inside and outside, otherwise, the user accepts the payment of the fixed amount of €100 for cleaning and disinfection. The toilet and wastewater deposits will be duly emptied, otherwise, the user accepts the payment of the fixed amount of €100 for cleaning and disinfection.

• The lessee may contract the cleaning and disinfection service of the vehicle by notifying it in advance for a fixed amount of €100

11.- If the client wants to extend the lease of the vehicle beyond the established dates, he must notify the lessor well in advance of the end of the contract. The eventual confirmation of the extension will be subject to the availabilities that the lessor has at that time, therefore not assuming this last prior commitment. Unauthorized delays in delivery or due to duly justified force majeure will be penalized with a daily rate triple the amount applied in the contract.

12.- The vehicle object of this contract is insured according to the law, with a franchise from €700 per accident, therefore, if any accident occurs during the term of the lease, the client will bear said amount, which from now on authorizes it to be compensated in its case with the deposit constituted. Civil liabilities arising from facts or circumstances not contemplated as included in the policy will be the exclusive responsibility of the client.

13.- The deposit will be returned after the vehicle has been examined. Which, in case of damage due to misuse, will determine by means of a detailed note, the amount that the client must pay, authorizing the lessee to compensate said amount of the deposit deposited. If it is not possible to assess the damage immediately, the lessor will have 30 days to return, if applicable, the amount of the remaining deposit, once the cost of repairing the damage or damage caused has been deducted. In case that the amount of the damages is higher than the deposit, the lessee agrees to pay the difference in period of less than 15 days from when the corresponding invoice is issued, in case otherwise the amount of the difference will be seen increased by 10% for each day of delay.

14.- The non-presentation of the lessee at the place of delivery, on the date indicated in this contract, will be considered unilateral termination of the contract and of the reservation, by the client, with 100% penalty of the reservation amount, it will also empower the lessor to dispose of the reserved vehicle, the lessee not having the right to any type of indemnity or compensation.

15.- The vehicle is delivered with a completely full diesel tank, and it must be returned completely full, the liter of diesel that the landlord has to add to complete the deposit, will be billed at the current price and in the case of verifying the presence of diesel or other fuels in any other tank other than the one indicated for such as clean water, wastewater, etc. The amount of the cleaning and disinfection of the deposits will be withheld from the deposit.

16.- SMOKING IS ABSOLUTELY FORBIDDEN IN THE MOTORHOME, If the lessor verifies that there has been smoking, he is authorized to consider it as a damage, assuming the lessee the cost of deodorization, cleaning and in case of not being able to deliver the vehicle to the next lessee, the compensation costs for reservation that will be withheld from the bail.

17.- The kilometer limit for rentals is as follows:

• Weekend reservations (3 days): 800km included.
• Reservations from 7 days onwards: unlimited km.

Excess mileage will be billed at €0.20/km. From 7 days, the mileage is unlimited.

18.- The lessee undertakes to use the vehicle diligently and responsibly, assuming exclusively the responsibilities for driving under the influence of alcohol, drugs, legal or illegal, as well as for jeopardizing the integrity of the vehicle by taking it on roads or roads not regulated.

19.- The loss of keys or documentation of the vehicle by the lessee entails the payment of €200, for each of these, as replacement and will be deducted from the deposit.

20.- In case of breakage, damage or symptom of breakdown, the lessee must notify the lessor as soon as possible to assess the problem, the lessee will do at all times what the lessor tells him for the best and fastest problem solution. This notifications of vital importance. Failure to notify may affect the timely delivery of the vehicle to the next lessee, so the lessor may demand the corresponding amount for successive rentals. The lessee will not be entitled to any claim in the event of breakage, damage or breakdown, during the rental period, since the vehicles leave our facilities in perfect state of inspection and operation.

21.-In case of litigation by both parties waiving jurisdiction that may correspond to them, they submit to the courts of Madrid.

22.- The Vehicle will be delivered clean inside and out and must be returned in the same condition, otherwise the cost of cleaning and disinfection will be deducted from the deposit, the amount of which is the amount mentioned above.

23.- In compliance with the provisions of LO 15/99 on the Protection of Personal Data and RD 1720/07, Development Regulation, we inform you that the data collected by JLCASORT PROJECTS, S.L with the purpose of carrying out Accounting, fiscal and administrative management, as well as the sending of commercial, advertising and promotional communications, will be stored in the file owned by JLCASORT PROJECTS, S.L.
